Chapter 12 Family Farmer Bankruptcy

A Chapter 12 Bankruptcy is similar to a Chapter 13 Bankruptcy, however, is exclusively available only to farmers under certain restrictions and qualifications. A Chapter 12 Bankruptcy allows for the seasonal environment that is involved with farming and the large amount of debt that is carried for equipment and supplies. Just like in a Chapter 13 Bankruptcy, a monthly repayment plan is proposed for a period of 36 to 60 months. A discharge results from a successful completion of the monthly bankruptcy repayment plan.
